HB1020  TAKE ACTION NOW!  Request from the Colorado Association of Commerce & Industry (CACI) Staff

Chamber Members:

Ask your legislator to oppose HB1020.

Colorado recently plummeted from 8th to 21st in the US Chamber of Commerce's annual survey of state business litigation environments. HB1020 will only worsen the perception and reality that Colorado is tilting the litigation playing field against businesses. TAKE ACTION NOW!

When a plaintiff rejects a pre-trial settlement offer, goes to trial, then fails to beat that offer at trial, it wastes the time and money of the defendant's business, the Court, and the taxpayers. Colorado law encourages settlements by making any party that rejects a reasonable pre-trial settlement offer pay the other's post-offer costs.

HB1020 changes this balanced system by tilting the rules for the plaintiff and only the plaintiff. It gives a plaintiff and his attorney that recovers as little as $1 in trial all to the plaintiff's pre-offer costs going back to the start of the lawsuit - even after the plaintiff rejects a better settlement offer.

HB1020 will actually discourage settlement offers!

Thank you,

P.S. Please enter this e-mail address into the box on the right of the TAKE ACTION link and update your profile information. Please let us know what issues matter most to you!
